In New South Wales, the penalties for shoplifting offenses can vary depending on the value of the stolen property and whether the offense is classified as an indictable or summary offense. Here are the general penalties:
Summary Offense (less serious shoplifting offenses):
For property valued at less than $2,000: Maximum penalty of 2 years imprisonment and/or a fine of up to $11,000.
For property valued at $2,000 or more: Maximum penalty of 2 years imprisonment and/or a fine of up to $11,000 if dealt with in the Local Court. If dealt with in the District Court, the maximum penalty can be up to 2 years imprisonment and/or a fine determined by the court.
Indictable Offense (more serious shoplifting offenses):
For property valued at less than $5,000: Maximum penalty of 5 years imprisonment if dealt with in the Local Court. If dealt with in the District Court, the maximum penalty can be up to 5 years imprisonment.
For property valued at $5,000 or more: Maximum penalty of 7 years imprisonment if dealt with in the Local Court. If dealt with in the District Court, the maximum penalty can be up to 7 years imprisonment.
